The Scottish Club of Tulsa ("S.C.O.T.") is a private club operating in "the private" in Tulsa, Oklahoma. These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of you, and the Scottish Club of Tulsa, concerning your access to and use of scottishcluboftulsa.com and its communities. You agree that by accessing scottishcluboftulsa.com and its communities, that you have read, understood, and agreed to be bound by all of the Legal Terms. scottishcluboftulsa.com and its communities are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for a membership with the S.C.O.T.

4.1 By sharing any content contribution (including any text, photographs, graphics, video, or audio) with the S.C.O.T., you agree to grant to the S.C.O.T., free of charge, permission to use the material in any way it wants (including modifying and adapting it for operational and editorial reasons) for S.C.O.T. services in any media worldwide (including on the Scottish Club of Tulsa's site accessed by international users). In certain circumstances, the S.C.O.T. may also share your contribution with trusted third parties.

4.2 Copyright in your contribution will remain with you, and this permission is not exclusive, so you can continue to use the material in any way, including allowing others to use it.

4.3 In order for the S.C.O.T. to use your contribution, you confirm that your contribution is your own original work, is not defamatory, and does not infringe any U.S.A. laws, that you have the right to give the S.C.O.T. permission to use it for the purposes specified above, and that you have the consent of anyone who is identifiable in your contribution or the consent of their parent/guardian if they are under 18.

4.4 We normally show your name with your contribution unless you request otherwise, but for operational reasons, this is not always possible. The S.C.O.T. may need to contact you for administrative or verification purposes in relation to your contribution or in relation to particular projects. 4.5 Please do not endanger yourself or others, take any unnecessary risks, or break any laws or statues when creating content to share with the S.C.O.T.

4.6 If you do not want to grant the S.C.O.T. the permission set out above on these terms, please do not submit or share your contribution to or with scottishcluboftulsa.com.

5.2 You agree to use scottishcluboftulsa.com communities (including message boards) in accordance with the following Community Rules. You should, however, read the local house rules of the particular site or service you're using, as there may be some local variations to these Community Rules.

5.3 About your posts:

  • 5.3.1 Contributions must be civil and tasteful.
  • 5.3.2 No disruptive, offensive, or abusive behavior: contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble.
  • 5.3.3 No unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually-oriented, racially offensive, or otherwise objectionable material is not acceptable.
  • 5.3.4 Be patient: users of all ages and abilities may participate in the relevant scottishcluboftulsa.com community.
  • 5.3.5 No spamming or off-topic material: we don't allow the submission of the same or very similar contributions many times. Please don't re-submit your contribution to more than one discussion or contribute off-topic material in subject-specific areas.
  • 5.3.6 No advertising or promoting without written consent from the Council of the Scottish Club of Tulsa.
  • 5.3.7 No inappropriate (e.g. vulgar, offensive etc) user names.
  • 5.3.8 Contributions containing languages other than English may be removed unless allowed in the relevant local house rules.
  • 5.3.9 No impersonation.
  • 5.3.10 Deliberate misuse of the complaints facility is not permitted. If you persist in doing this, action may be taken against your account.

5.4.1 You will be assigned one user login and password per paid club membership. Memberships created for the purpose of disrupting the S.C.O.T. community or annoying other users will result in immediate termination of your user account.

5.4.2 All memberships must be registered with a valid personal email address that you access regularly so that moderation emails can be sent to you. Memberships registered with someone else's email address, or with a temporary email address may be closed without notice. We may require users to re-validate their account if we believe they have been using an invalid email address.

5.4.3 The S.C.O.T. reserves the right to close memberships if any user is seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple S.C.O.T. memberships, or if a non-U.S.A. user pretends to be a U.S.A. user, or disrupts any of our services in any way.

We advise that you never reveal any personal information about yourself or anyone else (for example: telephone number, postal address, home address, email address, or any other details that would allow you to be personally identified) in any online S.C.O.T. community.

5.6.1 You may not submit or share any defamatory or illegal material of any nature in scottishcluboftulsa.com communities. This includes text, graphics, video, programs or audio.

5.6.2 Contributing material to a scottishcluboftulsa.com community with the intention of committing or promoting an illegal act is strictly prohibited.

5.6.3 You agree to submit to or share with scottishcluboftulsa.com communities only contributions which are your own original work. You must not violate, plagiarize, or infringe the rights of the S.C.O.T. or third parties, including copyright, trademark, trade secrets, privacy, publicity, personal or proprietary rights.

5.7 The Scottish Club of Tulsa does not approve individual memberships for persons under the age of 18.

5.8.1 If you fail to abide by these Community Rules (and/or any variations in relevant local house rules) when taking part in a scottishcluboftulsa.com community, you will be sent an email which informs you why your contribution has been refused or edited. This email will also include a warning that continuing to break the rules may result in action being taken against your account or membership.

5.8.2 This action may include any content posted by you being checked before being allowed to go on the site or a temporary or permanent suspension of your ability to participate in any or all of the scottishcluboftulsa.com community areas.

5.8.3 If you submit or share offensive or inappropriate content to or with any scottishcluboftulsa.com communities or anywhere else on scottishcluboftulsa.com or otherwise engage in any disruptive behavior on scottishcluboftulsa.com, and the S.C.O.T. considers such behavior to be serious and/or repeated, the S.C.O.T. may use whatever information that is available to it about you to stop any further such infringements. 5.8.4 The Scottish Club of Tulsa reserves the right to delete any contribution or take action against any S.C.O.T. account at any time for any reason.

6.1 The majority of content posted in scottishcluboftulsa.com communities is created by members of the S.C.O.T.. Occasionally, content is posted that is created by members of the public. The views expressed are theirs and, unless specifically stated, are not those of the Scottish Club of Tulsa or the Scottish Club of Tulsa Store. Neither the Scottish Club of Tulsa nor the Scottish Club of Tulsa Store are responsible for any content posted by members of the public on scottishcluboftulsa.com or for the availability or content of any third-party sites that are accessible through scottishcluboftulsa.com. Any links to third-party websites from scottishcluboftulsa.com do not amount to any endorsement of that site by the Scottish Club of Tulsa or the Scottish Club of Tulsa Store, and any use of that site by you is at your own risk.

7.1 If any of these terms are determined to be illegal, unlawful, invalid, or otherwise unenforceable by reason of the laws or statutes of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable.

7.2 The failure or delay of the S.C.O.T. to exercise or enforce any right in these terms does not waive the Scottish Club of Tulsa's right to enforce that right.

7.3 These terms shall be governed by and interpreted in accordance with the laws of the United States of America and the State of Oklahoma, which shall have exclusive jurisdiction over any disputes.
